Terms of Service

1. Eligibility and accounts

You must be at least 13 years old (or the minimum age required in your country) to use Vivid Stories. You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity under your account. Notify us promptly of any unauthorized use.

2. Your content

You retain all ownership of the photos, text, and other content you upload (“Your Content”). You grant Vivid a limited, non-exclusive, worldwide license to host, store, reproduce, adapt (for example, resizing or format conversion), and display Your Content solely to operate and provide the service — including displaying your stories at the visibility level you choose. This license ends when you delete Your Content or your account, except for content you have shared publicly that others have copied, and for reasonable backup retention.

You are responsible for Your Content and represent that you have the rights necessary to upload and share it, including the consent of any identifiable people who appear in your photos where required by law.

3. Acceptable use

You agree not to use Vivid Stories to:

• Upload content you do not have the right to share, or that infringes others' rights.
• Post unlawful, harmful, harassing, hateful, or sexually exploitative content, including non-consensual intimate imagery or any content that sexualizes minors.
• Impersonate others or misrepresent your affiliation.
• Upload malware or attempt to disrupt, probe, or gain unauthorized access to the service.
• Scrape, resell, or misuse the service or other users' content.
• Violate any applicable law or regulation.

You can report content that violates these Terms through our reporting page.

4. Sharing and visibility

You choose whether each story is private, password-protected, or public. You are responsible for how you distribute links and passwords. Public stories may be accessible to anyone and indexed by search engines. We are not responsible for how people you share with use or redistribute your content.

5. Google Photos integration

If you connect Google Photos, you authorize Vivid to import only the photos you explicitly select through Google's Photos Picker. Your use of Google services is also governed by Google's terms. Our handling of Google data is described in our Privacy Policy. You can revoke access at any time from your Google Account settings.

6. Subscriptions and billing

Vivid Stories offers a free tier and paid subscriptions. Paid plans are billed in advance on a recurring basis through our payment processor (Stripe) and renew automatically until canceled. You can cancel at any time, effective at the end of the current billing period. Except where required by law, payments are non-refundable. We may change prices or plan features with reasonable notice.

7. Our intellectual property

Vivid Stories, including its software, design, and branding, is owned by Vivid Labs and protected by intellectual property laws. These Terms do not grant you any right to our trademarks or to copy or reverse engineer the service.

8. Termination

You may stop using Vivid Stories and delete your account at any time; see Account deletion. We may suspend or terminate your access if you violate these Terms or to protect the service and its users. Provisions that by their nature should survive termination will survive.

9. Disclaimers

Vivid Stories is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, secure, or error-free, or that content will never be lost. Keep your own copies of important photos.

10. Limitation of liability

To the maximum extent permitted by law, Vivid Labs will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill. Our total liability for any claim relating to the service will not exceed the greater of the amount you paid us in the twelve months before the claim or USD $100.

11. Indemnification

You agree to indemnify and hold Vivid Labs harmless from claims and expenses arising out of Your Content, your use of the service, or your violation of these Terms or the rights of others.

12. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. The state and federal courts located in California will have exclusive jurisdiction over disputes not subject to arbitration or small-claims resolution.

13. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the date above and, where appropriate, notify you. Your continued use of Vivid Stories after changes take effect means you accept the updated Terms.
